Jamie Foxx News: The actor is denying accusations made by an anonymous woman against him in a new lawsuit that alleges the actor sexually assaulted her at a New York City restaurant in 2015.
A spokesperson for the 55-year-old actor, told PEOPLE on Thursday in a statement, “The alleged sexual assault incident never happened.”
In the year 2020, an individual initiated a lawsuit strikingly similar in nature within the confines of Brooklyn. Swiftly, this case faced dismissal,” the narrative persisted. “The assertions possess no greater validity in the current moment than they did in the past. Our confidence remains steadfast that a similar fate awaits these claims.”
“And upon their anticipated dismissal, Mr. Foxx harbors intentions to bring forth a claim for malicious prosecution against this party and her legal representatives for the renewal of this baseless legal action,” the spokesperson appended.
The legal grievance against Foxx materialized in the New York Supreme Court on a Wednesday. Documents procured by PEOPLE reveal that the accuser, designated solely as Jane Doe, narrated the purported incident transpiring in August 2015 at Catch NYC.
According to the alleged victim, upon entering the establishment’s rooftop bar and lounge with a companion, they espied Mark Birnbaum, co-founder of Catch Hospitality Group, seated “one table away. At approximately 1:00 a.m., as per the complainant, she and her companion approached Foxx’s table seeking a photograph with the esteemed Academy Award winner.
Allegedly, he responded, “Certainly, my dear, anything for you,” and proceeded to capture “multiple photographs.” Foxx, as per the woman’s assertions in the complaint, appeared to be under the influence and purportedly remarked: “Impressive, you possess that physique of a supermodel,” “Your fragrance is delightful,” and “You resemble Nickie.”
The legal submission claimed that once Foxx guided Jane Doe to a secluded space, he “positioned both hands on her waist, maneuvered them beneath her ‘crop top,’ and commenced palpating her breasts.”
The purported victim attested to having “attempted to distance herself from Foxx” and noted the presence of a security guard who, allegedly witnessing the transgression, purposefully distanced himself.”
Doe claimed that Jamie Foxx proceeded to insert his hands into her pants, placing fingers on and within her vagina and anus. Upon her companion’s return, Foxx purportedly ceased contact with the accuser and ambled away to stand alongside a security guard.

The lawsuit against Foxx was submitted on the final day allowed under New York’s Adult Survivors Act, granting victims of sexual assault, 18 years or older at the time of abuse, a one-year retrospective period to litigate against their perpetrator and, if relevant, the institution that shielded them, irrespective of the time elapsed since the occurrence, per MSNBC.
Within the legal filing, Jane Doe maintained she “has endured and continues to endure physical and emotional afflictions, anxiety, distress, embarrassment, and economic detriment.” She seeks reparations for pain and suffering, financial losses, as well as punitive damages exceeding the jurisdictional limits of all lower courts.
